Hotel Business Interruption & Financial Damages

15 October 20265 Mins Read

In Brief: Gary Isenberg presents a case study detailing the expert witness process for evaluating hotel business interruption and financial damages, emphasizing the importance of accurate loss quantification and thorough documentation for successful insurance claims and legal proceedings.

Understanding Hotel Business Interruption Losses: Why Lost Revenue Is Not the Same as Lost Damages

One of the most common misconceptions in hotel business interruption claims is the assumption that lost revenue automatically translates into economic damages.

In reality, it rarely does.

Accurately measuring hotel damages requires far more than identifying a decline in revenue. It requires understanding how hotels operate, how demand fluctuates, and whether the claimed losses are truly attributable to the event in question.

A recent engagement illustrates why this distinction matters.

Legal counsel retained me as a hotel expert witness to evaluate a hotel that experienced a significant operational disruption and to assess the economic damages claimed by the property’s owner. While the claim initially appeared straightforward, the analysis quickly revealed the importance of separating financial assumptions from operational reality.

The Assignment: Hotel Operations vs Financial Damages

I was engaged to evaluate the impact of a significant operational disruption on a hotel’s performance and to assess the resulting economic damages claimed by the owner.

The assignment required analyzing both the hotel’s operating circumstances and the financial assumptions underlying the damages claim.

Why Hotel Business Interruption Claims Are Different

Hotels operate a highly perishable business model. An unsold room cannot be placed back into inventory and sold tomorrow. Once the night passes, that revenue opportunity is lost forever.

The challenge is determining which losses were actually caused by the disruption and which resulted from market conditions or other unrelated factors.

Key considerations that the lawyers wanted advisory on:

  • Changes in occupancy, ADR, and RevPAR
  • Seasonal demand patterns
  • Group, corporate, and transient business mix
  • Food and beverage and meeting revenue impacts
  • Competitive market performance
  • Avoided operating expenses
  • Additional costs incurred because of the disruption

Just as importantly, the analysis required distinguishing between lost revenue and lost profit.

Hotel Analysis Approached

The first step was determining how the hotel would likely have performed had the disruption never occurred.

To establish that “but-for” scenario, the historical operating results, market trends, seasonality, and comparable hotel performance were analyzed

Then thehotel’s actual operating results were evaluated during the affected period, including occupancy, ADR, RevPAR, departmental revenues, and operating expenses.

From there, the focus shifted to operational impact:

  • How many rooms were unavailable?
  • Were guest services affected?
  • Was meeting space lost?
  • Did food and beverage operations suffer?
  • Were groups canceled, displaced, or relocated?

Only after understanding the operational realities could the financial damages be properly assessed.

The analysis also evaluated:

  • Lost revenue
  • Avoided expenses
  • Incremental costs
  • Resulting profit loss
  • Alternative assumptions affecting the damages calculation

The Key Question: Were the Damages aligned with the Disruption?

The central issue was whether the hotel owner’s damages claim accurately reflected the hotel’s actual economic loss attributable to the disruption.

That required separating:

  • Revenue lost because of the disruption
  • Revenue affected by market conditions or unrelated factors
  • Expenses that would have been incurred regardless
  • Expenses that were avoided
  • Additional costs incurred to mitigate losses

This distinction is critical.

In hotel litigation and expert witness cases, lost revenue does not automatically equate to lost profit. A credible damages analysis must consider both sides of the equation.

The Value of Hospitality Industry Expertise

Extensive hotel operating experience provides an important perspective when evaluating financial assumptions. Numbers tell an important story, but they must be tested against how hotels actually function.

In this engagement, that perspective helped the lawyers and legal counsel evaluate:

  • The reasonableness of projected performance
  • The practicality of revenue assumptions
  • The appropriateness of expense allocations
  • The consistency of the methodology with industry practices
  • The strengths and limitations of competing analyses

In my experience, understanding hotel operations, revenue generation, labor requirements, and market dynamics is often the difference between a theoretical analysis and one grounded in operational reality.

Final Thoughts

Business interruption claims are not simply accounting exercises. They require an understanding of hotel operations, market dynamics, revenue generation, and expense behavior.

The central question is not simply how much revenue was lost. The central question is whether the claimed damages accurately reflect the economic impact of the disruption.

In hotel litigation, that distinction often makes the difference between a theoretical damages model and a credible assessment supported by both the facts and the realities of hotel operations.
