After just about six long weeks of attorney statements, witness testimony and jury deliberation, the latter of which took approximately seven days, Lindsay Clancy’s very public trial ended in a mistrial on Sept. 4. That has now led to weeks of interviews with jurors (particularly regarding the holdout juror who reportedly left the jury at an impasse of 11-1), statements from Clancy’s attorney Kevin Reddington and plenty of online speculation. Even Clancy’s ex-husband, Patrick Clancy, has given interviews, including a fairly lengthy sit-down with 60 Minutes alongside his wife Rachel Danis just recently.
Now, three weeks after that mistrial was declared, Clancy is heading back to court for a brand-new hearing today, Sept. 29, and this could very well be the hearing that determines the outcome of her case. Specifically, Reddington has been pushing for the case to be dismissed, as well as requesting an investigation into the holdout juror, who multiple other jurors have alleged had reasonable doubt but refused to apply the law. The outcome of either request remains to be seen, although the fact that Reddington previously fought the mistrial and was unsuccessful has some believing Judge William Sullivan is unlikely to toss the case now.
Yet another factor is what the Plymouth County prosecutors are going to do, as, on the day of the mistrial, District Attorney Tim Cruz stated that no decision was going to be made or provided regarding whether they would retry the case. It’s therefore possible that the prosecutors will not attempt another trial, although that’s not something that they are widely expected to do. Cruz’s passionate speech on that day about justice for Clancy’s three children, Cora Clancy, Dawson Clancy and Callan Clancy, suggests that they do not intend to drop the case.
Hopefully, we will get answers to some of these major questions today, as many eyes continue to be on the case.
